Que pr\u00e9voit la loi et quelles sont les assurances recommand\u00e9es \u00e0 charge du locataire et \u00e0 charge du propri\u00e9taire&nbsp;?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les assurances \u00e0 charge du locataire<\/strong><\/h2>\n\n\n\n<p>Le locataire est responsable des dommages qu\u2019il pourrait provoquer entre les murs qu\u2019il loue et dans les parties communes d\u2019un immeuble. Il est dans l\u2019obligation de souscrire une assurance couvrant la responsabilit\u00e9 locative en cas d\u2019incendies ou de d\u00e9g\u00e2ts des eaux par exemple mais \u00e9galement les catastrophes naturelles ou technologiques, les actes de terrorisme, les temp\u00eates\u2026.<\/p>\n\n\n\n<p>Dans le cadre de locations saisonni\u00e8res, d\u2019un bien meubl\u00e9 ou d\u2019un logement de fonction cette assurance n\u2019est pas obligatoire mais vivement conseill\u00e9e dans la mesure o\u00f9 le locataire peut \u00eatre tenu pour responsable en cas de dommages.<\/p>\n\n\n\n<p>Cette responsabilit\u00e9 locative est tr\u00e8s souvent assortie d\u2019une assurance recours voisins et des tiers qui couvre les dommages qui pourraient intervenir dans un b\u00e2timent adjacent dont le locataire pourrait \u00eatre responsable, tels qu\u2019une fuite d\u2019eau ou un incendie par exemple.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les assurances \u00e0 charge du propri\u00e9taire<\/strong><\/h2>\n\n\n\n<p>Le propri\u00e9taire est lui aussi tenu de couvrir sa responsabilit\u00e9 en souscrivant une assurance recours voisin et tiers ou de trouble de jouissance dans le cas ou un vice de construction interviendrait, ou un d\u00e9faut d\u2019entretien provoquerait des dommages ou, si le locataire ne pourrait pas utiliser le local lou\u00e9 conform\u00e9ment aux stipulations du bail. Non obligatoire, cette responsabilit\u00e9 est toutefois fortement recommand\u00e9e.<\/p>\n\n\n\n<p>S\u2019il s\u2019agit d\u2019une copropri\u00e9t\u00e9, l\u2019assurance collective doit couvrir la totalit\u00e9 des b\u00e2timents, parties priv\u00e9es et communes, ainsi que les responsabilit\u00e9s encourues envers les locataires, les voisins et les tiers.<\/p>\n\n\n\n<p>Il est vivement conseill\u00e9 de faire le point avec son assureur afin de&nbsp;<strong>r\u00e9partir l\u2019assurance<\/strong>&nbsp;en fonction des risques inh\u00e9rents aux locaux \u00e0 consid\u00e9rer.
